The arbitrator shall have the authority to award any remedy or relief available under applicable law, including compensatory damages, but shall not have the authority to award punitive or exemplary damages. The decision of the arbitrator shall be final, binding, and non-appealable, and judgment upon the award may be entered in any court having jurisdiction. Each party shall bear its own costs and attorneys fees in connection with any arbitration proceeding, unless the arbitrator determines otherwise.
